These Terms of Service ("Terms") govern your use of kovakream.com and any purchase you make from Kova ("we," "us," or "our"). By placing an order or using our website, you agree to these Terms.
1. About Kova
Kova is a fresh protein ice cream brand based in Los Angeles, California. We sell direct-to-consumer through our website. Delivery availability and coverage areas are detailed on our website and may change over time. All products are perishable, frozen food items made in small batches.
2. Eligibility
By using our site and placing an order, you confirm that you are at least 18 years of age and are legally capable of entering into a binding agreement. Orders must be shipped to a valid address within our delivery area.
3. Orders & Payment
All prices are listed in U.S. dollars. We reserve the right to update pricing at any time. Prices in effect at the time of your order will apply to that order.
We accept payment via the methods displayed at checkout. By submitting an order, you authorize us to charge your selected payment method for the full order total, including any applicable fees.
We reserve the right to cancel or refuse any order at our discretion — for example, in cases of suspected fraud, payment failure, or items that are out of stock. If we cancel your order, you will receive a full refund.
4. Subscriptions & California Automatic Renewal Law
Kova offers recurring subscription plans that automatically renew at the end of each billing cycle. By subscribing, you agree to the following terms, which are required under California's Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.):
- Recurring charges: Your subscription will automatically renew and your payment method will be charged at the rate and frequency selected at checkout, until you cancel.
- Pricing: Your subscription price and any applicable discounts are displayed clearly at checkout before you complete your purchase.
- Cancellation: You may cancel your subscription at any time with no cancellation fees. To cancel, log into your account at kovakream.com or email hello@kovakream.com. Cancellations requested after an order has already been processed for an upcoming delivery cycle will take effect on the following cycle.
- Confirmation: You will receive an email confirmation of your subscription terms at the time of purchase. Please retain this for your records.
- Renewal notices: For subscriptions renewing on an annual basis, we will notify you at least 15 days before your renewal date with the renewal amount, frequency, and instructions on how to cancel.
- Changes: We will notify you of any material changes to your subscription price or terms before they take effect.
5. Delivery
Delivery terms, coverage areas, and order cutoff times are posted on our website and subject to change. Please review current delivery information before placing your order.
Because our products are perishable, we are not responsible for quality issues resulting from missed deliveries due to incorrect addresses, failure to be present, or other circumstances outside our control. If a delivery issue occurs, contact us within 48 hours at hello@kovakream.com.
6. Perishable Products & Food Safety
All Kova products are fresh, perishable frozen food items. They must be kept frozen at all times. We are not responsible for product quality if items are thawed, refrozen, or improperly stored after delivery.
All sales are final on perishable food items. Please refer to our Refund & Satisfaction Policy for details on quality issues.
7. Allergens & Nutritional Information
Allergen and ingredient information is listed on each product page and on product packaging. Please review this information carefully before purchasing. Nutritional information is provided for reference and is calculated to the best of our ability based on ingredients used. We are not responsible for adverse reactions resulting from failure to review allergen information prior to purchase.
8. Health & Nutrition Disclaimer
Kova products are food items intended for general consumption. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and are not a substitute for professional medical or dietary advice. If you have specific health conditions, dietary restrictions, or concerns, please consult a qualified healthcare professional before consuming our products.
9. Intellectual Property
All content on kovakream.com — including text, images, logos, branding, and product descriptions — is owned by Kova and protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without our prior written permission.
10. Privacy
Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our site, you consent to the data practices described in our Privacy Policy.
11. Limitation of Liability
To the fullest extent permitted by law, Kova shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim related to a purchase shall not exceed the amount you paid for the order in question.
12. Disclaimer of Warranties
Our website and products are provided "as is." We make no warranties, express or implied, beyond those stated in our product descriptions and satisfaction policy. We do not warrant that our website will be uninterrupted or error-free.
13. Governing Law
These Terms are governed by the laws of the State of California and the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our site shall be resolved in the courts located in Los Angeles County, California.
